US Pauses Migrant Deportations

(MENAFN) US border authorities have been directed to suspend deportations of migrants under President Donald Trump’s contentious asylum limitations, following a federal court's decision that struck down major aspects of the regulation, as detailed in a report by a news agency.

The news agency’s article, referencing two officials from the Department of Homeland Security, indicated that the internal order was circulated over the weekend.

This came after a federal appeals court removed a temporary hold on a lower court’s verdict, which had previously invalidated Trump’s extensive asylum restrictions.

That lower court decision determined that Trump’s broad asylum prohibitions conflicted with current US legal frameworks.

These frameworks obligate the administration to assess applications for refuge from individuals who claim they would face "persecution or torture" if sent back to their native countries.

Although the appeals court recognized the president’s authority to place certain limitations on asylum access, it emphasized that the US cannot disregard its legal responsibilities under both American law and international commitments, such as the United Nations Convention Against Torture.

These obligations protect individuals from being deported to nations where they might suffer harm.

Following the ruling, officers from Customs and Border Protection (CBP) were instructed to handle migrants under regular immigration laws.

This includes considering asylum applications or other types of humanitarian protection, the report noted.

Going forward, authorities are expected to depend more extensively on expedited removal — a rapid deportation process.

However, this procedure still offers migrants the opportunity to request asylum if they can present a "credible fear of persecution."
